This Privacy Policy applies to any website, application, feature, widget or other online service that is owned or controlled by The Talbots, Inc., its subsidiaries and affiliated companies (i.e., companies affiliated with the Talbots and Haven brands, collectively “Talbots,” “we,” or “us”), that posts a link to this Privacy Policy (collectively, the “Channels”), and by Talbots offline. By using the Channels, you acknowledge the terms of our privacy policy in effect at the time of your visit.

By doing business with or interacting with the Channels in the manner described in this Privacy Policy at any time after the last updated date noted above, you are accepting the practices described in this Privacy Policy and you expressly consent to the application of this Privacy Policy to the collection, storage, use and disclosure of your personal information as described.  IF YOU DO NOT AGREE TO THE TERMS OF THIS POLICY AND THE APPLICABLE TERMS OF USE, DO NOT ACCESS OR USE THE SITES OR PROVIDE PERSONAL INFORMATION TO US THROUGH ANY CHANNEL OR PLATFORM.

Information We Collect  

We collect information from you and about you in order to provide you with the products you request, to improve and personalize our interactions with you, including through the Channels, and to more effectively market our products. The information we collect includes “Personal Information” as that term is defined under applicable laws. Personal Information includes information that identifies you as a specific, identified individual, such as your name and address. We will also treat additional information, including IP addresses and cookie identifiers, as “personal information” where required by applicable law. For example, we may collect:

  • Contact Information, such as name, address, email address, and shipping and billing addresses
  • Transaction-related information, such as what items you purchased or received, the total prices you paid, cancellation, return, and exchange information, products or services considered, and your participation in a sweepstakes or contest
  • Payment information, such as credit or debit card number and expiration date
  • User Account information, such as a username, password, and account settings
  • Demographic information, such as age, date of birth, marital status, sex and/or gender, income level, level of education, occupation or field
  • Photo/Video Data or other user generated content, such as videos captured through our in-store security cameras, and any photos, audio or video recordings you choose to share in connection with product reviews, survey responses, live chat or other customer service interactions, or posts in our community forum
  • Device ID information, such as IP address, mobile device ID, device model and operating system, mobile network information, approximate location information, the site or advertisement that referred you to our Channels, navigation patterns on the Channels, and the next site you visit after leaving the Channels
  • Information about your interests and preferences, such as information based on your searches on our Channels, your purchases and purchase activity, and your other activity on our Sites
  • Loyalty Rewards Information, such as account number, points, and promotion codes

How we collect information

Information You Provide

You may provide your personal information to us directly when you:

  • Place an order for a product through one of our Channels
  • Register for an account, sign up for style appointments or personal stylist services, create wish lists, or sign up for catalogs, email alerts, or text messages
  • Respond to surveys, submit reviews, enter contests or drawings, or register for and participate in loyalty programs
  • Contact customer service or other points of contact to submit questions or requests
  • Submit information to us through interactive features, social media platforms, or other communication functionality

Information That is Collected Automatically

We may collect information automatically when you visit and use our Channels (“Device ID / Interaction Information”). For example, we automatically collect your information when you open or respond to our emails, contact customer service or use support tools, visit any page that displays our ads or content, connect or link to any Channel via social networking sites, post comments to online communities or provide information to our service providers, including our advertising and business partners. The following are examples of how we automatically collect information through the Sites:

Browsing and Device Information: We automatically collect some information and data about your computer and mobile devices when you visit our Channels. For example, we will collect your IP address, web browser software, and information about referring websites. We also may collect information about your online activity, such as merchandise viewed and purchases made, as well as general location data that helps us to tailor the version of the Channel that you see in order to enhance your shopping experience.

Cookies: Cookies are small data files stored on your computer’s web browser. These technologies can store a unique identifier for a device to allow a certain Internet site to recognize the device whenever the devise is used to visit the site. These technologies may be used for many purposes by us and our third-party service providers, such as automatically collecting Device ID / Interaction Information, enabling features, remembering your preferences, and providing you with targeted advertising elsewhere online. If you do not want to accept cookies, you can block them by adjusting the settings on your Internet browser, however, some features of the website may not function if you block all cookies.  You may also elect to limit the use of cookies in connection with targeted advertising, as described in the Third Party Advertising and Analytics section below.  

Pixel Tags: We use 'pixel tags' (small graphic images also called web beacons or clear gifs) or similar technologies to track information in the aggregate about your use of the Sites like the web pages you view, the links you click, and the time you spend on a page. We use this information to monitor the effectiveness of our advertising and marketing campaigns so we can learn how to best deliver your customer experience. We also use pixels to track our email campaigns to determine whether recipients opened the email and what links they clicked on from the email.

Embedded Scripts:  An embedded script is programming code that is designed to collect information about your interactions with the Sites, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to a Site, and is deactivated or deleted thereafter. 

Analytics tools and aggregate data: The Sites use analytics tools, such as Google Analytics and Adobe Analytics, web analytics services provided by Google, Inc. and Adobe, Inc., respectively. Google Analytics and Adobe Analytics use cookies to help the Sites analyze how you use the Sites. The information generated by the cookie about your use of the Sites (including your IP address) will be transmitted to and stored by Google and Adobe, respectively, in aggregate form. Google and Adobe may use this aggregated information in order to evaluate use of the sites, compile reports on Sites activity and other services relating to Sites activity and usage. Session Replay Tool: We use session replay technology to help us reconstruct the user experience on our Channels. We use this technology to troubleshoot issues with and improve user experience on our sites. The tool provides insight into what works and what doesn’t work for users of the sites, and it allows us to, for example, identify and repair technical errors, such as broken links that impair the Sites’ functionality. We may also use the tool to authenticate users, enable Sites features, prevent fraud, and implement security measures. The tool uses cookies and similar technologies to collect and analyze information related to user behavior on our sites, such as mouse movements, clicks, user inputs, scrolling, access times, visit duration, pages viewed, IP address (including location), operating system, page reloading, crash data, performance data, and other diagnostic data. The tool also collects name, email address, phone number, and physical address if you enter this data during a session. The Service Provider we utilize for session replay is prohibited by contract from using data collected using this feature for any other purpose, or from selling or sharing any data collected by us using the session replay tool.  

Chat Technology: Our Channels use a chat feature to respond to customer inquiries. These chat features collect personal information, including but not limited to email address and the content of the chat communications, on our behalf. Conversations conducted via the chat feature are recorded, and you should not continue with chat assistance if you do not consent to recording. Recorded chat sessions are used by us internally and are not sold, shared, or used for purposes of targeted advertising.  

Information Collected from Third Parties

We may also collect your personal information from third parties, including:

Third Party Platforms: If you connect or interact with us on third-party sites or applications, such as social media platforms, the third-party platform may send us your information, such as your profile information from that platform. The information collected and disclosed to us is controlled by the third-party platform and its terms and privacy policy or as you direct by adjusting your privacy settings on the third-party platform.

Send-to-a-Friend Features: We may make available on the Channels a “send-to-a-friend,” “refer a friend,” “wish list” or similar function that permits you to send Channel content directly to a third-party through the Channels. If you send a friend a communication using such functionality, the information you provide about your friend (e.g., name and email address) is used to facilitate the communication and is not used for any other marketing purpose unless we obtain consent from that person. If you disclose any personal data relating to other people, you represent that you have the authority to do so and to permit us to use the data in accordance with this Privacy Policy.

Data brokers: We may obtain information about customers or potential customers from third party sources, such as data brokers or address verification vendors for purposes of fulfilling your orders or requests, better understanding and analyzing our business and your experience, and to more effectively market our products to customers.  

How we use information

We may use your personal information to accomplish our business purposes, including to:

  • Complete your transaction, process and ship your order, or respond to your questions or requests
  • Personalize your experience, store your preferences, provide user-experience features, and to operate our business and provide our products and services
  • Administer our business (e.g., to make improvements to the sites, conduct analytics, and enhance our products and services)
  • Facilitate your participation in our loyalty programs, personal style services, and other customer offerings
  • Allow you to create and maintain wish lists and other information in your account
  • Communicate with you, including by electronic means, about your order, special offers, promotions, and other products or services we think may be of interest to you
  • Create and administer contests, drawings, special events, and surveys
  • Enhance and customize your customer experience and customer service in our stores, call centers, and on the Sites
  • Respond to reviews, comments, or other feedback you provide or questions you submit
  • Manage and customize promotional offers and advertisements we think may be of interest to you and to conduct data analysis and related activities
  • Detect and prevent fraud and protect the security and integrity of the Sites and our stores and systems
  • Protect our legal rights or the health or safety of our customers, employees, or others
  • Comply with our legal obligations or respond to law enforcement, legal and regulatory inquiries or requests, or legal proceedings

how we share information

When appropriate, we may share your information with:

Affiliated Brands, Including for Direct Marketing: We may share your information with our family of companies, including companies associated with the Talbots and Haven brands, which like Talbots are also owned, directly or indirectly, by the same parent companies for business, analytical, and operational purposes. We also share personal data with these affiliated companies so that they may contact you with their own direct marketing. You may opt out of our sharing personal data we have collected about you with Affiliated Brands for their direct marketing purposes as described in the Updating Your Personal Data section below.

Service Providers: We engage with select service providers who provide services to support our operations, such as: order processing and fulfillment, market research, advertising and promotion of products, managing promotions and contests, websites analytics, and other support services. Such parties may, from time to time, have access to your information to enable them to provide the services. Service Providers are prohibited from selling or sharing your information, or from using your information for purposes beyond the scope of the services they are providing on our behalf.

Third Party Marketing Services: We may use third-party service providers to perform certain services on our behalf, such as hosting the Channels or Channel features, delivering packages, processing credit card payments, processing transactions and fulfilling orders, removing repetitive information from customer lists, providing customer service, providing website usage analytics, providing search results and links (including paid listings and links), providing targeted advertising, sending email, direct mail or other communications, providing marketing assistance and data analysis or enhancement, or performing other administrative services. We may give these service providers access to your information (or allow them to collect information from or about you) so that they can carry out the services they are performing for you or for Talbots Brands.

Additionally, we may share various information relating to our users and fraudulent or potentially fraudulent activities with our fraud prevention and similar service providers, and they will use this information to help us and their other clients prevent fraudulent and illegal transactions.

One company with whom we may work is Borderfree, a U.S.-based service provider that we may contract with to facilitate the sale and fulfillment of international online purchases. Where Borderfree will be used to fulfill your international purchase, information that you provide during the checkout process will be collected by or provided to Borderfree and will be processed in accordance with Borderfree’s own privacy policy found at: https://www.borderfree.com/privacy/en_us/. By making such a purchase, you agree to Borderfree’s Privacy Policy and Terms & Conditions of Use. 

Unaffiliated Third Parties for Direct Marketing: We may share personal data with unaffiliated third parties for their own direct marketing and other purposes. You may opt out of our sharing personal data we have collected about you with unaffiliated third parties for their direct marketing purposes as described in the Updating Your Personal Data section below.

Other Third Parties: As further described in the HOW WE USE INFORMATION section above, we may share your information to protect your safety or the safety of others when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing injury to you, our employees or otherwise injuring or interfering with our rights, property or operations, other customers, or anyone else who could be harmed by such activities; to comply with legal obligations, such as when required by law, or in response to any demand by law enforcement authorities in connection with a criminal investigation, or civil or administrative authorities in connection with a pending civil case or administrative investigation; and to maintain the security of the Channels and services and to resolve or troubleshoot technical issues.

When you agree to receive information from third parties or request that we share your information: We will disclose your information to a third party (or parties) when you direct us to do so or you consent to the sharing, and your information will then be subject to the privacy policy and practices of that third party. For example, you may be presented with an opportunity to receive information or marketing offers from one or more third parties or to use an interactive feature or third-party application.

Cobranded Credit Card: When you apply for and use a branded credit card, Talbots may share certain data at your direction to facilitate your application and use of the card. In addition, Talbots may share data with the issuing bank for our Talbots credit card, and its affiliates, for purposes related to those credit cards. For example, we may share information to send joint offerings, including information on how to apply for an Talbots credit card, and in connection with your use of an Talbots credit card, such as to maintain or service accounts and to effectuate transactions. We may also share data with these parties for analytics purposes.

Business transfers and transitions: We reserve the right to sell, rent, disclose, or transfer your personal information to a successor entity in the event of a corporate merger, consolidation, sale of assets, bankruptcy, or other corporate changes respecting us or our affiliated companies.

We may work with network advertisers, ad agencies, analytics service providers, and other vendors to serve our advertisements on our Channels and third-party websites, apps, and elsewhere online, to provide us with data regarding use of and traffic on the Channels (including without limitation the pages viewed and the actions users take when visiting the Channels), and the effectiveness of our advertisements. For example, if you click on an advertisement for Talbots, our service provider(s) may be able to tell us the advertisement you clicked on and where you were viewing the advertisement. The advertisements you see may be served by us or one or more third parties, who may use data about your activities on the Channels, and other websites and services you visit across the various devices you use, to provide you targeted content and advertising. Our service providers may collect certain data about your visits to and activity on the Channels and other websites and services and may use this data to target advertising to you.

These third parties may set and access their own tracking technologies on your device (including without limitation cookies and web beacons) and may otherwise collect or have access to information about you (such as Device ID/Interaction Information). Some of these parties may collect personal data over time when you visit the Channels or other online websites and services. Cookies and web beacons, including without limitation those set by third-party network advertisers, may be used to (among other things): target advertisements, prevent you from seeing the same advertisements too many times, and conduct research regarding the usefulness of certain advertisements to you. We may share certain data, such as device identifiers, Device ID/Interaction Information, hashed information, records of transactions you conduct on our Channels or offline, and other types of de-identified or pseudonymized data with third-party advertising companies, analytics providers, and other vendors for advertising and analytics purposes. In addition, we and our third-party service providers may use this data to perform matching with third-party cookies to provide targeted online marketing. If you would like to opt-out of third-party advertising and analytics, there are a variety of tools available to you:

  • Cookie Opt-Out Tools: To disable sharing through cookies set on our site by third parties for advertising and analytics purposes, please adjust your settings by using our Cookie Management Tool  .  Residents of some states have additional rights to opt-out of the sharing or processing of their personal information for purposes of targeted advertising, as described in the Jurisdiction-Specific Rights section below.

 

  • Do Not Track / Global Privacy Control: Do Not Track ("DNT") signals offered by some web browsers are settings that request that a web application disable its tracking of an individual user. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and/or other web services you encounter while browsing to stop tracking your activity. Global Privacy Control ("GPC") is a technical specification in your browser settings that you can use to automatically inform websites of your privacy preferences with regard to third party online tracking.   • NAI/DAA Opt-Out: Some of the companies we use may be members of the Network Advertising Initiative ("NAI") or Digital Advertising Alliance ("DAA"). The NAI provides information regarding targeted advertising and the opt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connected devices, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising. You may also want to visit the DAA's website, which provides information regarding targeted advertising and offers an opt-out for DAA-participating companies.

 

  • Google Analytics: We use Google Analytics, which use cookies and similar technologies to collect and analyze information about the use of the Channels and report on activities and trends. This service may also collect information about the use of other websites, apps, and online services. Please note that opting out through these mechanisms does not opt you out of being served advertising, and that you will continue to receive generic ads while online.   • Text Messages from our Stores: While shopping with us, an associate may give you the option to opt-in to receive text messages from your local store about new product information, style appointments, promotional events, and transactional information on the mobile phone number(s) you have shared with us. We will not contact you via text messages for marketing purposes without your prior consent. You do not have to opt-in to text messages to make purchases from us.   • Opt-Out of Targeted Advertising:  Talbots engages in online advertising practices (and certain analytics or similar activities) that may be considered "targeted advertising" under certain states’ laws.   • Updating Your Personal Data: The Channels may contain webpages or applications through which you can correct or update some of the personal data you have provided (such as via an online account) or through which you may be able to unsubscribe or modify the email newsletters or similar communications we send to you. If you have an online account, you are responsible for maintaining and updating, as applicable, your account registration data with current, accurate, and complete information. We may provide links on the Channels to third-party websites we think may be of interest to you, including plugins that link to social media sites, such as Facebook, Pinterest, and Instagram. These websites are independent from Talbots and have their own separate privacy policies. We are not responsible for the privacy practices or content of such third-party websites and embedded applications. Whenever you click on links on the Sites that take you to a third-party website or embedded application, you will be subject to the third-party’s privacy policies. We recommend that you review the third-party’s privacy policies before you visit these websites and embedded applications.

Our Channels are intended for a general audience and are not intended for use by or targeted to children younger than the age of 18. We do not knowingly collect personal data from children younger than the age of 18. By using the Channels or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your data in the United States and other jurisdictions, for which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. Verifying Your Requests

Notice of Financial Incentive

Under California regulation, certain aspects of our loyalty and similar programs, which provide benefits to consumers, may be considered a financial incentive program. We collect personal information from you in connection with our loyalty program, e.g. contact information (such as name, email address, residential address) and commercial information (such as purchase history) for a number of reasons, including to administer the program, contact you with regard to your account (if any), provide the benefits to you, better serve you, and fulfill your requests associated with the program.
